These quotes are weird it keeps messing up the posts. Maybe I am doing something wrong The trick is to scroll down to the bottom of the Preview box and click below the quote, or use BBCode and scroll down before clicking and typing. I think there is a setup that automatically selects BBCode in your preferences.

The problem is that we have elevated contention to an art form in this country. Any attempt to craft a new Constitution at this point would result in bloodshed, I'm certain. We'll get the bloodshed eventually, anyway (no polity lasts forever and this one, I suspect, will die angry). Perhaps then it will be possible to build a Constitution that's more up to date. Until then, I'd say we go the Amendment route.
The Founding Fathers made it hard to amend the Constitution for good reason. I think it should be harder to pass new laws: what about requiring 60% of the votes to pass, and 75% for those things that now require a 60% supermajority?

Also add 40% to repeal a law as well, I would like to see a whole industry spring up to repeal old outdated, or unenforced laws.

Can't we just try the one we have again for a little bit? I mean, seriously, it's been at least 50 years. It used to work pretty well once upon a time.

How about a Constitutional Amendment that term limits every federal law other than the Constitution? If everything sunsets in, say, 10 years it would keep Congress very busy just keeping the government functioning.

They have crafted distracting the American public (trying to push through Amnesty during the shutdown, for example) quite well. It's time they get a taste of their own medicine.

Seems like the 2nd is the one that has the most confusion regarding its exact intent. Guns are way down in my list of importance, anyway. We are losing all kinds of important personal rights. Including one of the most important, Our Right To Bear Arms. Guns made America great and free.

I'm sorry but having our congressmen sitting around wasting their time seems like a great way for America to fail. We need to be on top of our game. Maybe we ought to try electing some real people, not media selected stars, and also try getting big money out of politics to see what's really going on. I don't trust any of these guys, they're bought and sold . It's amazing how many of them and up being professional lobbyists when they retire. We need to elect people that have real jobs and when they are done in politics they go home to their real job again to suffer the laws that they made

are we allowed to discuss guns here? I know there is a gun category To the extent that it's relevant to a new Constitution, sure. Let's not turn this thread into a pro/anti gun rights thread, though.

Excellent post.

There are no limits to what a constitutional convention can do so that had best be a bag of snakes left unopened. Amendments are the only safe way to go "Bag of snakes" indeed! IIRC, back in the early 1970's, when PL94-142 (that's "mainstreaming") was enacted, it was the longest law ever written, some 300+ pages. Now, consider Obamacare and Dodd/Frank-- thousands of pages directing the administration to write thousands of regulations. How long is that abomination, the USAPatriot Act? Our income-tax code is longer than the King James version of the Bible. There simply aren't enough trees in the world to print even one copy of a new Constitution. NO LIMITS! That means every lobbying group would have representatives, each determined to get whatever gimcrack and doo-dad they're currently selling written into the Constitution. (Consider the amendment to the MD Constitution that not only made casinos legal in general, but mandated specific locations for each one. Multiply that by every special interest in the nation.) Now, imagine a Constitution written by people who are True Believers in the beneficence of a powerful, central government, always caring for a recalcitrant, often foolish but never wise, population... Kinda like having snakes write the rules dictating the behavior of mice.

Looks like I got it "almost" right, but not quite. Life is not a zero-sum game

"This is the CENTRAL SCRUTINIZER . . . it is my responsibility to enforce all the laws that haven't been passed yet. It is also my responsibility to alert each and every one of you to the potential consequences of various ordinary everyday activities you might be performing which could eventually lead to The Death Penalty (or affect your parent's credit rating). Our criminal institutions are full of little creeps like you who do wrong things . . . and many of them were driven to these crimes by a horrible force called MUSIC!
Our studies have shown that this horrible force is so dangerous to society at large that laws are being drawn up at this very moment to stop it forever! Cruel and inhuman punishments are being carefully described in tiny paragraphs so they won't conflict with the Constitution (which, itself, is being modified in order to accomodate THE FUTURE).

Tipper Gore proved she does not understand freedom or the Constitution with the PMRC.

Tipper Gore proved she does not understand freedom or the Constitution with the PMRC. Nor does her husband. Zappa, hunter thompson, and many others knew encroachment by government is inevitable and the only protection we have is the constitution......pity we've lost that understanding. To so many pols, d and r, the constitution is optional-including our esteemed constitutional scholar.....see patriot act....see aca.... One of the few who seem to get it (heaven help me) is dennis kucinich.
