Do charges have to be filed to make something illegal? Interesting question coming from someone who thinks Hillary Clinton has been "persecuted." Hillary has manifestly committed several crimes (including felonies). Here's the thing though, until a case has been tried in court, accusations of criminality are just that: Accusations. Those accusations have varying degrees of validity. Take the case of Roy Moore versus that of Al Franken. Roy Moore has been accused of molesting teenaged girls. The accusations are 40 years old, and range from just hitting on them to something at least very close to rape. Given the amount of time that has passed, they likely can't be tried in court to arrive at any semblance of due process. There is no way, really, to validate the accusations other than deciding whether or not one feels the acccusors are credible. To be clear: I do find them credible, and I hope Moore loses. (My God, what will you do if that happens?!) I also hope Jones loses. Al Franken on the other hand has been accused of little more than being a bit too pushy/grabby with women. Compared to the accusations against Moore, Franken is a veritable chiorboy. The difference though, is the accusations against Franken date from the current century, and there's photgraphic proof of him being a pig. So what are we to make of these two cases? Really, only that they're not very similar. It is reasonable to believe that the accusations against Moore are false (or at least not sufficently proven). While it is unreasonable to believe the accusations against Franken are false, due to the photograph evidence, it is potentially reasonable to argue his piggishness doesn't rise to a level that necessitates his resignation (which he himself argued in his resignation speech).

The quick answer, RJ, is no, charges do not have to be filed to make something illegal. Violating the law is the illegal action.
You're correct that Moore cannot be prosecuted for his alleged actions. The statute of limitations in Alabama at that time for those crimes was 3 years. It was, I believe, changed in the early 80s, but has no impact on these charges.
It's interesting that you say you find Moore's accusers credible, and then turn around and claim that it is reasonable to believe them false or not sufficiently proven. You believe them. Why? What more evidence or testimony do you need?
And, if photographic evidence is sufficient for something that occurred in the last 10 or 20 years, what about audio tapes?

Unless the accused is Saint Hillary of Clinton, who is, was and ever shall be a martyr to the cause. Even if she shot someone on the street. I find the accusations against Moore are credible only because I find the accusations seem to follow the same pattern and the accusers are compelling. But I have to stipulate that there is no proof, and The Washington Post's decision to print this story after the primary was obviously naked partisanship, which significantly undermines the story's credibility. This case is a judgement call. I find it compelling and credible, but I understand why others do not. As for audio tapes, if you're referring to the Access Hollywood open mike tape of Trump, I read somewhere that Howard Stern LINK has several similar tapes. He has refused to release them because he understands that his show is about shock value, and the nothing that is said on his show, or in his studio, can be taken at face value. It's entertainment, and may or may not really reflect what the person who makes the comment actually believes. In short, Stern knows the difference between what people say on his show and reality, and considers it inappropriate to hold people responsible for the things they say on his show. Access Hollywood is a less salacious TV version of the Howard Stern show. Sadly, they lack Stern's sense of ethics and morality.

I agree with much of what you said... 'cept the pic of Franken only shows that he was a comic... and the woman said he "pretended" to grope her... which the picture bears out... As for Moore... I don't have any doubt that his accusers are 100% honest... but it's been too long to prove... and the statute of limitations has run out... it's extremely hard to prove sexual allegations... (without a blue dress)... even if it were last week... think Duke Lacrosse...

Not really a good state to measure Democratic success in. I do agree that both parties have moved to almost cartoonish extremes. Granted Alabama is a deep-red state, but how extreme is the Democrat if he can't beat Chester the Molester? A more moderate candidate beats Moore.

Clinton settled the Jones suit to get it off the TV... realy didn't cost him anywhere near $850G...
